Users only authorise VOLUME 3 to use them to the extent necessary to review the enquiry, assess the project and conduct the corresponding pre-contractual discussions. Any subsequent use will be governed by the terms specifically agreed between the parties. The receipt of ideas, concepts or references does not grant the sender rights over techniques, processes, methodologies or solutions previously developed by VOLUME 3 or subsequently developed independently.

7. Confidential Information

The Website’s general contact forms and channels do not, by themselves, constitute a channel subject to a specific confidentiality agreement. Users should therefore avoid submitting particularly sensitive information, trade secrets, unpublished projects or materials subject to special confidentiality obligations where their disclosure requires a prior confidentiality commitment. Unless expressly authorised or permitted by law, no act of reproduction, transformation, distribution, public communication, making available or exploitation of protected content may be carried out.

9. Portfolio and Work Created for Third Parties

An essential part of the Website consists of showcasing projects and work in which VOLUME 3 has participated professionally, whether directly for an end client or in collaboration with agencies, production companies, studios, artists or other professionals. The publication of a project in the portfolio does not mean that VOLUME 3 owns all rights existing in that project or in each of its elements. Rights belonging to clients, agencies, production companies, studios, authors, artists, trademark owners or other third parties may coexist in the same work. The materials are displayed for portfolio, professional promotional and informational purposes regarding VOLUME 3’s experience, within the scope of the corresponding rights or authorisations.

10. Scope of VOLUME 3’s Participation

Where a project page identifies the “End Client”, client, agency, production company, collaborators, disciplines performed, VOLUME 3’s “Focus” or other credits, that information should be understood as a description of the context and scope of VOLUME 3’s participation. The inclusion of a project on the Website does not necessarily mean that VOLUME 3 produced the entire work, created all its elements, participated in every phase, owns all rights in it or has a direct contractual relationship with the end client. The credits and information published for each project will determine, where applicable, the scope of its participation.

11. Trademarks and Other Third-Party Rights

Projects included in the portfolio may incorporate trademarks, trade names, logos, products, designs, photographs or other elements belonging to third parties. All such elements belong to their respective owners and their inclusion on the Website is solely for identification, descriptive or illustrative purposes in relation to the relevant project.Unless expressly stated otherwise, their appearance does not imply sponsorship, a corporate relationship, representation, exclusivity, a permanent partnership or general endorsement of VOLUME 3 by their owners. Access to the Website does not grant users any rights over such trademarks or content.

12. Use of Website Content

The content of the Website is made available to the public to enable users to learn about and assess VOLUME 3’s work and professional capabilities. Unless expressly authorised by the rights holder or permitted by law, users may not copy, reproduce, redistribute, publish, commercialise or reuse portfolio content; incorporate it into third-party portfolios, campaigns, products or productions; remove or alter credits; extract assets; or create unauthorised derivative works. The technical ability to view, store or download certain content does not constitute authorisation to reuse or exploit it. Likewise, the publication of breakdowns, making-of materials, wireframes, processes, simulations or other technical materials is for demonstration purposes and does not authorise the extraction of assets, reconstruction of source files or reuse of intermediate production materials.

13. Automated Extraction, Text and Data Mining and Artificial

Intelligence VOLUME 3 expressly reserves the rights it may hold in the Website content against text and data mining, automated extraction and use for the training or development of artificial intelligence systems, to the fullest extent permitted by applicable law. Where applicable, this provision constitutes an express reservation of rights for the purposes of Article 67.3 of Spanish Royal Decree-Law 24/2021 of 2 November. Unless prior express authorisation has been granted or an applicable legal exception exists, systematic extraction of Website content is not authorised for the creation of datasets or for training, fine-tuning, validating or developing machine learning or artificial intelligence models, including generative image, video, animation, 3D or other content systems. This reservation applies to the extent that VOLUME 3 holds the relevant rights in the affected materials. Making content publicly available for viewing does not constitute authorisation to use it as training material for artificial intelligence systems.14. Third-Party Links and Content The Website may include links to websites, social media platforms, audiovisual platforms or other services operated by third parties. VOLUME 3 does not control such services and shall not be responsible for their content, availability, security, terms or privacy practices. The inclusion of a link does not necessarily imply approval or recommendation of all content available on the linked website. Links to the Website are permitted provided that they do not mislead users as to the relationship with VOLUME 3, suggest a non-existent authorisation or collaboration, or place its content in an unlawful or misleading context. Framing or other techniques that may create confusion as to the origin or ownership of the Website or its content are not authorised.

15. Accuracy, Availability and Changes to the Website

VOLUME 3 seeks to ensure that the information included on the Website is accurate and reasonably up to date, but this does not constitute an absolute guarantee of accuracy, currency or availability. The publication of a particular project, service, technique or capability does not guarantee its future availability or the achievement of identical results in other projects. VOLUME 3 may modify, update, correct or remove content and functionalities at any time. VOLUME 3 will also seek to keep the Website available, although interruptions may occur due to maintenance, updates, technical failures, third-party services, security incidents or other circumstances beyond its reasonable control.
